Short Sale May Not Be The Answer To Your Money And Income Problems

A short sale may not be the answer to your money, income and real estate problems. A short sale is a very difficult and damaging process for both you and the lender. Your lender may not let you do a short sale as a quick fix to your problems. Just because you think you can't afford your mortgage, doesn't mean the lender will let you do a short sale. Try to find an alternative to your money and income problems, other than a short sale.

Bad News For Real Estate Market: Unemployment and Foreclosure Continue Into 2010

In a recent press conference, the Mortgage Bankers Association released its annual “State of the Industry” facts and figures. Bad news for the recovery of the economy and the real estate market -- It looks like unemployment and foreclosures will still be on the rise through 2010, preventing any substantial economic improvement. Unemployment and foreclosures are clearly linked, and any improvement in the real estate market and the economy cannot happen without improvement from both.

Under the rules for joint tenancy with rights of survivorship, you should be able to receive the property that you already co-own and continue paying on the mortgage if the other co-owner passes away. The due on sale clause in most mortgages should not be triggered if the property passes to your name after the co-owner's death. Joint tenancy with rights of survivorship allows the property to pass directly to you without any problem from the due on sale clause, as long as you keep paying the payments.

Refinancing while you're unemployed may not be possible even with a large amount of savings and a high net worth since lenders are requiring more documentation. If you want to refinance, you will be required to show proof of employment, cash reserves, and more documentation. Without a job, any lender will probably not be willing to refinance your mortgage.

The End Of Universal Default: Foreclosure Will Not Raise Credit Card Interest Rates

In the past, Universal Default could make your credit card interest rates go up. If you went into foreclosure on your mortgage, your credit card company could increase your interest rate because of universal default. Under the new credit card legislation that goes into effect February 2010, universal default will not be allowed, based on foreclosure or anything else not related to your credit card. Take the time after foreclosure to concentrate on paying off your debt and raising your credit score.
